I. Data protection

1. Information on data processing during your visit to our website
We process personal data that is created when you visit our website or that you communicate to us in accordance with data protection regulations.

You can always visit our website without providing personal data. We only collect personal data if this is required, for technical purposes for the use of our website, or if you use certain functions on our website such as contact forms. We collect your personal data to enable the required functions.

When you visit our website, our web servers automatically save the IP address assigned to you by your Internet service provider, the website you clicked from, the web page of ours you visit, any downloads, the quantity of data requested, search terms, as well as the date and time. This data is recorded for the duration of three months. We use this information to identify and correct any security risks or malfunctions on our website. The legal basis for this data processing is Article 6 Paragraph 1 f) GDPR (General Data Protection Regulation), according to which data processing is permissible for the protection of legitimate interests. Our legitimate interests are the safeguarding of website functions and the early detection and prevention of cyber attacks. 

We also collect your information when you contact us using the contact form available on the website or in any other way. Unless specified otherwise in connection with the contact form, we will use this data only for the purpose of responding to your request and for technical administration. We identify all data that is compulsory as such. You may be asked to give additional personal information. This information is voluntary and is only used to process your inquiry. The data we process when you use our contact form is based legally on Article 6 Paragraph 1 b) GDPR if the data is required for the performance of a contract.

2. Information on the use of cookies and similar technologies
Eberspächer uses cookies in order to implement certain functions on our website that are required for technical reasons, to understand how our offers are used, to continuously optimize our websites and to provide you with the content that you need. Cookies are small text files that a website stores on your hard drive. Cookies cannot cause any damage to your computer, execute programs or contain viruses. In place of cookies, we may use what are known as web beacons or similar common technologies that store (sometimes temporarily) information on specific users and user processes. You can prevent cookies from being stored on your computer via your browser settings at any time; please use your browser’s settings or help function to do this. This may prevent you from using certain features on our website. Eberspächer uses cookies for various purposes. The different types of cookies are listed below.

Technical cookies.
For the most part, these cookies enable you to use the features on the site, e.g. to retain form data (e.g. in a contact form) or to control what information is displayed (e.g. the cookie banner). The legal basis for the processing of data in connection with technical cookies is Art. 6, Para. 1 (b) GDPR. It is not possible to disable technical cookies.

Analytics cookies.
Other cookies enable analysis of website use for statistical purposes. They allow us to learn, for example, what content on our website is particularly relevant for our users and what devices are used to access the site. This allows us to make our website more interesting for our users. The information on the browsers and devices used allows us to adapt our site design to suit the most important browser types. We use these cookies only with your consent. The legal basis for the processing of data in connection with analysis cookies is your consent (Art. 6, Para. 1 (a) GDPR). You can withdraw your consent by visiting cookie settings and changing the relevant setting.

Marketing cookies.
We also use cookies for advertising and marketing purposes in order to enable targeted ads and to show you advertising on external websites (e.g. on Google or Facebook) for products and offers that you were interested in on our website or that match content that we believe is of interest to you. General information about possible interests of our website users and of other users that is collected by third parties on other websites is also used to enable the targeted advertising of our content (known as retargeting). For this purpose, the information is saved to a cookie identifier. The information cannot identify you as an individual but is recognized purely on the basis of your device. When the cookies are deleted, the advertising content is no longer personalized. We use these cookies only with your consent. The legal basis for the processing of data in connection with marketing cookies is your consent (Art. 6, Para. 1 (a) GDPR). You can withdraw your consent by visiting cookie settings and changing the relevant setting.

We advise that under certain circumstances some of our websites have cookies that are not directly related to Eberspächer. If you visit a site with content that has been embedded by third parties (e.g. YouTube or Issuu), these third parties may have placed their own cookies. Eberspächer can neither influence the use of these cookies nor access them due to the way they function; they can only be accessed by those who have originally placed them there. Google Tag Manager
We use Google Tag Manager, a service that is offered for users in the European Economic Area, Switzerland and Liechtenstein by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”) and for all other users by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Tag Manager helps us to manage the tools and external services that we use on our websites and allows us to use what are known as tags. A tag is a code element that is inserted into the website source code and can, for example, control which site elements or service primitives (operations) and tools are enabled and loaded and in what order. Google Tag Manager itself does not collect any personal data. The tool can be used to trigger other tags that may themselves collect data and that are further outlined in these guidelines on data protection. You can read more about Tag Manager in the information provided by Google. Tag Manager is required for technical reasons.

Usercentrics
We use a tool provided by Usercentrics GmbH, Sonnenstrasse 23, 80331 Munich, Germany (“Usercentrics”), to display the cookie banner and to save, manage and document your cookie preferences. A cookie is used in conjunction with Usercentrics to save your cookie settings preference for the Eberspächer website. The Usercentrics tool is required for technical reasons.

Google reCAPTCHA
Our website uses the Google reCAPTCHA service, which is provided for users in the European Economic Area and Switzerland by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, and for all other users by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (collectively, “Google”). Google reCAPTCHA is used for IT security purposes, to ensure that our website is stable, to prevent misuse and to prevent automated software (called “bots”) from carrying out inappropriate activities on the website. In other words, it checks whether the details given were definitely entered by a human. Certain data is processed in order to carry out this check. This includes the referrer URL (the address of the website from which the visitor came), IP address, snapshots of the browser window, how the user entered the information, and technical information about the browser and its settings. In addition, Google reads the cookies from other Google services. If you do not wish information about your Google account to be linked with our website, you must log out of Google before visiting a page where we have incorporated Google reCAPTCHA. The data concerned is encrypted before being sent to Google. Google analyzes the statistics from reCAPTCHA users but states that it does not use these for the purposes of targeted advertising. Google reCAPTCHA is required for technical reasons. If personal data is transferred to the USA or to other third countries, the transfer is made on the basis of Article 49 (1) (b) GDPR to enable us to fulfill a contract with you or to carry out pre-contractual activities. Google Analytics
Our website uses the web analytics service Google Analytics, which is offered for users in the European Economic Area, Switzerland and Liechtenstein by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”) and for all other users by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses cookies with a validity of 38 months to record your access data when you visit our website. Google compiles this access data to create anonymous usage profiles on our behalf and transfers them to a USA-based Google server. Your IP address is anonymized beforehand. We are therefore unable to recognize which user profiles belong to which particular users. We therefore cannot identify you or determine how you use our website based on the information collected by Google. In the exceptional event that personal data is transferred to the USA, we have contractually agreed with Google that it will comply with European data protection principles. However, when data is processed outside Europe, in individual cases the rights of EU citizens may not be protected or may only be partly protected. This is the case, for example, if the U.S. security agencies store and analyze data. Your data will only be transferred to the USA if you give your consent via our cookie banner. You can withdraw your consent at any time by disabling Google web analytics in your cookie settings.

Google uses the information obtained by cookies on our behalf in order to evaluate website use, compile reports on website activity and provide us with further services associated with the use of our website and the Internet. Please refer to Google Analytics’ privacy policy statement for more information.

The cookies used in connection with Google Analytics are analytics cookies. We use these cookies only with your consent. You can disable Google’s web analytics at any time by visiting cookie settings and changing the relevant setting. In addition to this, you also have the following options:

Google Ads Conversion Tracking
We also use Google Ads Conversion Tracking, an analytics service from Google. Google Ads places a cookie on your computer (“conversion cookie”) if you accessed our website via a Google ad. These cookies expire after 30 days and are not used for personal identification. If you visit specific sites of ours when the cookie has not yet expired, both Google and Eberspächer can recognize that a user has clicked on the ad and was thus redirected to our site. Every Ads customer receives a different cookie. This means that cookies cannot be monitored via the websites of Ads customers. The information retrieved by conversion cookies is used to create conversion statistics for Ads customers who have opted for conversion tracking. Ads customers receive data on the total number of users who have clicked on their ad and been redirected to a site with a conversion tracking tag. However, these customers will not receive any information that can identify the user.

The cookies used in connection with Google Ads Conversion Tracking are marketing cookies. We use these cookies only with your consent. You can disable these cookies at any time by visiting cookie settings and changing the relevant setting. Please refer to Google’s privacy policy for more information.

Google Ads
Through targeted advertising on Google’s sites and those of its partner network, we use Google’s remarketing technology to reconnect with users who have already visited our website and are interested in our offers. Cookies are used to display the ads. User behavior on the website is analyzed with cookies, and the resulting analysis is used for targeted product recommendations and interest-based advertising.

The cookies used in connection with Google Ads are marketing cookies. We use these cookies only with your consent. If you do not wish to receive interest-based advertising, you can disable these cookies at any time by visiting cookie settings and changing the relevant setting, or you can disable Google’s use of cookies for these purposes by visiting https://www.google.de/settings/ads/onweb . Alternatively, you can disable the use of cookies by third parties by visiting the Network Advertising Initiative’s opt-out page .

Facebook Remarketing
For marketing purposes, we use Facebook’s conversion and retargeting tags (also known as the Facebook pixel), a service provided by Facebook Inc., 1601 Willow Road, Menlo Park, California 94025, USA (“Facebook”). We use the Facebook pixel to assess the effectiveness of Facebook advertising (conversion) and to show you targeted advertising on the basis of your interest in our products (retargeting).

For this purpose, Facebook processes data that has been collected via cookies and similar technology on our websites. Facebook is thereby notified that you visited our website using a device with a particular IP address. If you have a Facebook account, Facebook can, depending on your privacy settings, match your visit to our website to your Facebook account and use this information to place targeted Facebook ads.

Facebook can transfer and save the data arising from this process to a server in the USA for analysis. In the event personal data is transferred to the USA, we have contractually agreed with Facebook that it will comply with European data protection principles. However, when data is processed outside Europe, in individual cases the rights of EU citizens may not be protected or may only be partly protected. This is the case, for example, if the U.S. security agencies store and analyze data. Your data will only be transferred to the USA if you give your consent via our cookie banner. You can withdraw your consent at any time by disabling Facebook Pixel in your cookie settings.

The cookies used in connection with Facebook are marketing cookies. We use these cookies only with your consent. You can prevent Facebook from collecting your data at any time by visiting cookie settings and changing the relevant setting. If you have a Facebook account, you can make further changes to how your data is processed in connection with Facebook ads by visiting your account’s privacy settings.  Please refer to Facebook’s data policy for more information on how it processes data.

Google Maps
We use Google Maps on our sites to display geographical information in a visually accessible way and to help you find dealers. Google Maps is a mapping service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. In order for the Google map material we use to be integrated and displayed in your web browser, your web browser must connect to a Google server (which may be based in the USA) when you visit the contact page. Google is hence notified that the contact page of our website has been accessed from the IP address of your device. To enable this processing in the USA, we ask for your consent in our cookie banner before activating the map function. Please note that when data is processed outside Europe, in individual cases the rights of EU citizens may not be protected or may only be partly protected. This is the case, for example, if the U.S security agencies store and analyze data. You can withdraw your consent at any time by disabling the Google Maps service in your cookie settings.

If you access the dealer search function (including when requesting a quotation) on our website while logged into your Google profile, Google can link this event to your profile. If you do not wish your Google profile to be linked with our website, you must log out of Google before visiting our contact page, or before enabling the map function. Google stores your data and uses it for advertising purposes, market research and personalized presentation of Google Maps. You may deny Google permission to collect this data. For more information, please refer to Google’s privacy policy and the Additional Terms of Service for Google Maps/Google Earth.

3. Consent and your rights regarding data protection
All the personal data that you supply on Eberspächer’s website without your special consent will only be used for the purpose provided (e.g. for preparing a bid), and for technical administration. Upon each data entry, we will inform you of its intended purpose and may ask for you for consent for its further use. In these cases, the legal basis for data processing is the consent pursuant to Article 6 (1) (a) GDPR. Your consent is always voluntary, and you can revoke it at any time with effect for the future.

Furthermore, you may, even if you consented, object to your personal data being used for advertising or for market research and surveys, or request information about the data saved at any time. You also have the option of having your personal data that you have stored with us corrected, blocked or deleted at any time. Please contact the responsible department, which can be found in the legal notice, in writing or by e-mail. Please note that we exclude data from deletion that we require for processing outstanding services or enforcing our rights and claims. This also applies to data we must keep in accordance with legal requirements. Such data is initially locked.

If the service providers named in this agreement process your data outside the European Union, we will ensure that these providers guarantee contractually or otherwise an equivalent level of data protection to that of the European Union. You can request a copy of these guarantees via the contact details in the legal notice.

Finally, you are also entitled to request an electronic copy of the information that we process under a contract or on the basis of your consent (known as the right to data portability).

4. Changes to the privacy policy statement
Eberspächer reserves the right to change its privacy policy statement at any time without prior notice. We therefore recommend that you regularly keep up to date with any potential changes.

The content of this website may not be copied, distributed, changed or made accessible to third parties for commercial use without Eberspächer’s consent. Some of Eberspächer’s websites also contain images that are subject to copyright of third parties.

Press photographs may only be used for editorial-journalistic reporting on the Eberspächer Group and must be credited to “Eberspächer.” Printing and publication are free of charge for this. However, we request a print copy from print media or a brief notification from electronic media (Internet). Any other/commercial use of the images requires the prior written consent of the Eberspächer press department.

2. No guarantee
